**4% will be charged to all Credit Card Purchases. **All Sales Are Final **REGISTRATION and DEPOSITS: A valid Credit Card is required for Registration. $250.00 preauthorization for U.S. bidders by Credit Card including AMEX, VISA, MASTERCARD and DISCOVER (deposit will not be charged to card),Wire Transfer or Cashiers Check or Company Check with Bank Letter of Guarantee. Credit Cards will not be accepted as payment for amounts over $5,000.00 **Upon winning bid any non payment within 48 hours will result in the deposit being charged to winning bidders Credit Card. **BUYER’S PREMIUM: A buyer’s premium of 18% will be charged to all purchases. **IDENTIFICATION: All bidders are required to give company name, full name, address, phone number and Credit Card information when registering. All information must match the Credit Card used to register. **INTERNATIONAL BUYERS: Must submit a refundable deposit of $5000 by wire transfer ONLY to be approved to bid. **PAYMENTS: U.S. bidders by Wire Transfer, Cashiers Check, Company Check with Bank Letter of Guarantee. Credit Cards for amounts $5,000 and under. International bidders by Wire Transfer ONLY. Items won must be paid for within 48 hours of Sale Close. Upon winning bid any non payment within 48 hours will result in the deposit being charged to winning bidders Credit Card. **TIME AND MANNER OF PAYMENT: Upon notification of being the successful bidder, buyers will have 48 hours to pay in full via wire transfer, certified check or company check with bank letter or Credit Card if amount is $5,000 and under. PLEASE NOTE, all company checks MUST be accompanied by a bank letter of guarantee made out to Pearl Equipment Co. The full purchase price and loading cost must be paid prior to the removal of any goods.. **LOADING: Loading and Transportation is the responsibility of the buyer. Loading will ONLY occur by appointment, with qualified riggers and must be coordinated with Pearl Equipment Co. and the facility in advance. All items must be removed by August 17, 2017. **SALES TAX: Purchaser must supply a resale certificate or tax exempt form for all purchases in which they are claiming sales tax exempt status, otherwise local and state sales tax apply. The published sales tax rate is an estimation, and is subject to confirmation by state and local regulatory authority. **CONDITIONS OF ARTICLES SOLD: The Owner and Pearl Equipment Co. shall not be responsible for the correct description, genuineness, authenticity of, or defect in any lot and makes no warranty of the goods being sold. No sale shall be set aside nor allowance made on account of any error. NO DEDUCTION ALLOWED ON DAMAGED ARTICLES, ALL ARTICLES ARE BEING EXPOSED FOR PUBLIC INSPECTION, AND SOLD “AS IS” AND WITHOUT RECOURSE, ALL SALES ARE FINAL. ARTICLES ARE NOT WARRANTED AS MERCHANTABLE OR FIT FOR ANY PARTICULAR PURPOSE, AND NO CLAIM MAY BE MADE BY PURCHASER RELATING TO THE CONDITION OR USE OF THE ARTICLES PURCHASED, OR FOR PROXIMATE OR CONSEQUENTIAL DAMAGES ARISING THEREFROM. **INSPECTION: Inspection is encouraged and invited. By Appointment ONLY Call Cathy at (615) 383-8703 to schedule inspection. **SAFETY DEVICES: Articles purchased may not incorporate approved activating mechanisms, operating safety devices or safety guards as required by OSHA or otherwise. It is the purchaser’s responsibility that articles purchased be so equipped and safeguarded to meet OSHA and any other requirements before placing such articles in operation. **INDEMNIFICATION: Purchaser agrees to indemnify and hold owner, and Pearl Equipment Co. harmless from and against all claims and liabilities relating to the condition or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state, and locals laws applicable to such articles, including OSHA requirements, or for proximate or consequential damages, costs or legal expenses arising therefrom. **COMPLIANCE WITH TERMS OF SALE: In default of payment of bills in full within the time specified, the seller in addition to all other remedies allowed by law may retain all monies received as deposit or otherwise as liquidated damages. Lots that are not paid for or that are not removed within the time period allowed may be resold at public or private sale without further notice, and any deficiency, together with all expenses and charges or resale will be charged to the defaulting purchaser. **Seller reserves the right to reject any and all bids. **REMOVAL: All items must be removed by August 17, 2017. **QUESTIONS: Any questions please contact Todd Burgett @ (615)383-8703
