Sales Terms

General: These sales terms are governed by the laws of the jurisdiction in which the asset(s) are located. By participating in the auction, the Buyer acknowledges and agrees to be bound by these sales terms. These sales terms are the only terms which govern the sale of the asset(s) by Seller to Buyer.
Asset Condition: All assets are sold "as is, where is" without any warranties or guarantees, either express or implied. The Seller makes no representation or warranty as to the condition, functionality, or suitability of any asset for any particular purpose. The Buyer acknowledges and agrees to the Inspection Terms. See Inspection Terms for details.
Asset Pickup: Unless otherwise stated in the Removal Terms or confirmed in writing by a duly authorized representative of the Seller, if assets are not picked up within 14 days of making payment, the Buyer forfeits rights to the asset(s) and all monies paid, and no refunds will be provided. Seller is entitled to resell or dispose of abandoned asset(s) at their sole discretion.
Transfer of Title: The legal title and the risk of loss of the purchased asset(s) shall transfer from the Seller to the Buyer at time of pick up of asset(s).
Liability: The Seller shall be indemnified and held harmless from and against all claims, damages, losses, and expenses, arising out of or resulting from the sold asset(s). The Buyer acknowledges and agrees that upon pickup of the asset(s), the Buyer assumes all risk, responsibility, and liability for the asset(s), their transportation and their use.
SELLER MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE ASSET(S), INCLUDING ANY (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; (C) WARRANTY OF TITLE; OR (D) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE.

Removal terms

Removal Terms
Payment: Payment must be remitted in full before removal can begin. Removal charges will be collected by Aucto and disbursed to the appropriate party.
Pickup Appointments: Once payment is received in full, pickup appointments will be scheduled so the Buyer can retrieve purchased assets(s). Unless otherwise stated in Removal Terms, pickup appointments will be scheduled via the Aucto platform. The Seller agrees to provide reasonable availability for Buyer to pick up) during the 14 days after payment is received. Appointments will be booked with a minimum 48 hr notice. Buyers must fulfill scheduled appointment(s).
Documentation: Buyer or their authorized representative shall supply a Bill of Lading to Seller which will state an itemized list of purchased asset(s) to be released to the Buyer.
Rigging & Removal (by Seller): Unless otherwise stated in the Removal Terms or on the asset description, the Seller shall remove, prepare and load the purchased asset(s) onto transport equipment scheduled and provided by the Buyer. The Buyer is responsible for any Removal Costs listed on the asset(s), and for all costs of transportation of the purchased asset(s). The Buyer may designate a shipping vendor to complete a pickup appointment on their behalf and may delegate them as the point of contact for the appointment.

Payment terms

All payments must be made through the Aucto Payment Gateway (APG).

Buyers have below options to send payments:
- Wire Transfer
- ACH - Automated Clearing House (US)
- EFT - Electronic Funds Transfer (Canada)
- Credit Card (ONLY available for sale orders less than 5000 USD or 5000 CAD)
- Instructions will be available via APG to winners after a sale has concluded.

Aucto will NOT accept Cash, Check, E-Check, Cashier's Check or Bank Drafts as payment options.

Unless specified by the seller in the "Sale Terms", all payments are due within 24 hours of a sale
order being delivered.

Please submit tax exemption forms to support@aucto.com with your sale-order number in the
subject line. Local tax laws may apply to Aucto Buyer’s Premium (Aucto BP or ABP). In most
situations, tax on Aucto BP is not subject to tax exemption.
Inspection Terms Inspections are by appointment only. To request an inspection appointment, Buyer must have a valid Aucto account. Please email support@aucto.com with your name, Aucto account email address, and preferred inspection date. Seller will accommodate inspection requests to the best of their ability. Inspection dates: Monday, September 25th, 9 am-4 pm ET - By appointment only. Tuesday, September 26th, 9 am-4 pm ET - By appointment only.
